A well-known activist has petitioned the Supreme Court for judicial orders enabling the commission to select a new chief executive officer.
The main explanation for this has been Nancy Macharia’s advanced age.
The activists think that in order to make room for reforms at the commission, the TSC CEO ought to resign.
Judge Lawrence Mugambi was asked to make a good decision by activist Francis Owino during his presentation of his case before the high court.
He sought the judge to rule that Dr Macharia’s head of the panel is unconstitutional because she has already passed the mandatory retirement age.
The activist strongly believes that the CEO’s tenure should have ended in February of this year.

She emerged as the best candidate following a comprehensive interview process.

Dr. Nancy Macharia is the first female CEO of the TSC since the commission’s establishment.
The activist has also included the Ethics and Anti-Corruption Commission in the case.
He claims that the education committee members are oblivious to the situation.
However, the activist has not brought a complaint against parliament.
Earlier last year, CS Aisha Jumwa refused all proposals to allow public personnel to continue working after the age of 60.
She stated that every federal official who has reached the obligatory retirement age must retire.
The activist wants the court to issue orders prohibiting the TSC CEO from administering the commission.
Dr. Ken Mulunda will take over as the acting CEO until a new one is selected.
